PRIVACY POLICY 
of the association Aerial Silk Vienna

(hereinafter abbreviated: ASV)

 

1. GENERAL

1.1 The use of personal data by ASV is based on the applicable legal provisions and the consent given by the user to the use of his data.

1.2 ASV operates two aerial acrobatics studios. Various services and products in the field of aerial acrobatics can be booked, reserved or purchased via ASV. The offers are provided by ASV in its own sales. The subject of the contract is the use of the services of ASV (the "Service"), more precisely: aerial courses, workshops, training and other events. The services of ASV are used by customers or users (the "user" - used neutrally for both genders).

1.3 ASV is aware that the protection and careful handling of the user's personal data is very important. Since data protection is very important to ASV, ASV strictly adheres to the legal provisions applicable in Austria (GDPR, Telecommunications Act (TKG/TMG)) when using this data.

1.4 The user is required to visit ASV's General Terms and Conditions (GTC) regarding the subject matter of the contract, the user's obligations, limitations of liability and numerous other important information on the ASV website under the domain (www.aerialsilk.at).

 

1. COLLECTION OF DATA

2.1 ASV collects and stores any information that the user provides on the Eversports platform ("Eversports") and that is transmitted to ASV in the course of an online booking or that the user makes available to ASV in any other way, for example on site. ASV uses the user's personal data to the extent permitted by law and otherwise only with the user's consent. Insofar as consent is given electronically within the framework of an online booking via Eversports, Eversports takes into account the legal information requirements and logs this consent using suitable technical systems.

2.2 ASV uses the following personal data of the user: • name (first and last name) • e-mail address • address • telephone number • date of birth • and in some cases the IP address (“Cookies”): are processed automatically – e.g. by Google Analytics – and are not assigned to the user profile on Eversports)

 

1. PURPOSE OF DATA USE

3.1 We process your data as part of the fulfillment of the contract for the following purposes: 
a) Making reservations and storing open products b) Creating invoices c) Creating a booking history d) Information about current timetable changes and innovations in the offer (newsletter) e) Web analysis (see point 6.) f) Processing inquiries 2 g) Customer communication h) Evaluations You can object to this data processing. A revocation means that we will no longer process your data for the above-mentioned purposes from this point in time. It should be noted that the services of ASV can no longer be used in the event of a revocation and the user profile must be deleted in compliance with legal regulations. 3.2 If you have subscribed to our newsletter via the on-site registration form, we will process your data to send our newsletter. You also have the option of subscribing to our newsletter via our website. For this we need your e-mail address and your declaration that you agree to receive the newsletter. You can cancel your subscription to the newsletter at any time directly via the link in the newsletter emails or by sending an email to: office@aerialsilk.at. 
3.3 We store your data for the duration of the contractual relationship. Data that is on an invoice or is necessary for invoicing is stored longer due to the statutory retention period. After the retention period has expired, this data will also be deleted.

 

1. DATA SECURITY

4.1 For reasons of data security, personal data is stored in a closed system (Eversports) and protected with a password. 
4.2 Eversports is ASV's data processor and has taken appropriate measures to ensure data security (see: https://www.eversports.at/h/security). 
4.3 If ASV becomes aware that the user's data has been used systematically and seriously unlawfully and the user is at risk of damage as a result, ASV will inform the user immediately. 
4.4 The ASV website (www.aerialsilk.at) contains links to other services or websites. ASV is not responsible for the privacy policies and/or practices of other websites. If the user follows the link to another website, the user is solely responsible for familiarizing himself with the privacy policy of that other website. ASV's privacy policy is limited only to information processed by ASV. 
4.5 In addition to Eversports, ASV uses other processors for data processing. We pass on your data to the following additional recipients or categories of recipients: Communication tools for customer communication. Your data will be processed within the EU or the EEA // at least some of it will also be processed outside the EU or the EEA, namely in the USA. The appropriate level of protection results from an adequacy decision by the European Commission in accordance with Article 45 GDPR.

 

1. USE OF COOKIES

In order to make visiting our website attractive and to enable the use of certain functions, we use so-called cookies on various pages. These are small text files that are stored on your end device. Some of the cookies we use are deleted after the end of the browser session, i.e. after closing your browser (so-called session cookies). Other cookies remain on your end device and enable us or our partner companies to recognize your browser on your next visit (persistent cookies). You can set your browser so that you are informed about the setting of cookies 3 and decide individually whether to accept them or exclude the acceptance of cookies for specific cases or in general. If cookies are not accepted, the functionality of our website may be restricted.

 

1. DECLARATION OF CONSENT TO THE PRIVACY POLICY

By ticking the box when making an online booking with Eversports, the user confirms that he has read ASV's data protection regulations. When booking on site, the user confirms by signing the data protection regulations on site that he has read the data protection regulations of ASV. The user acknowledges that the personal data specified in point 2.2 will be used for the purposes specified in point 3.1.

8.2 In principle, you have the right to information, correction, deletion, restriction, data transferability and objection. For this please contact us. If you believe that the processing of your data violates data protection law or your data protection claims have otherwise been violated in any way, you can contact us directly. If we cannot resolve your case to your satisfaction, you have the right to contact the supervisory authority at any time. In Austria, the data protection authority is responsible for this.
