(hereinafter abbreviated: ASV)​
1. Scope of application
These General Terms and Conditions (GTC) apply to all services provided by ASV, in particular to courses and workshops at all locations where ASV holds them. By booking such a course unit, the customer accepts the following terms and conditions.

2. Right of use
a) With the purchase of a registration for courses or workshops, the customer is entitled to use the premises of ASV Studios during the course times offered. The customer is entitled to use the ASV premises for changing and showering 15 minutes before and 15 minutes after the end of the lessons/workshops.
b) The customer is generally entitled to use all services of the ASV studio. However, there is no legal entitlement to the use of services. The number of participants is limited for all classes and workshops. If special personal conditions are required for certain services, these must be fulfilled by the customer. If these conditions are not met, ASV shall not be obliged to provide the service.
c) The customer must always behave on the studio premises in such a way that the course of the lessons/workshops is not disrupted, the studio equipment is treated with care and there is no interference with other participants. In the interests of all participants, the customer must comply with the instructions of ASV employees. In the event of gross violations by the customer of these general terms and conditions and the corresponding instructions of ASV employees, such as assault, threats, insults, sexual harassment, theft, lack of hygiene, etc., access to the studio may be refused.

3. Terms of payment and withdrawal
When booking a course, payment is also made online. Course fees already paid cannot be refunded. However, the participant has the right to nominate a replacement participant up to 48 hours before the start of the course. Such a rebooking is free of charge for the participant. Partial participation in an event does not entitle the participant to a reduction in payment. Unless this has already been agreed at the time of registration (e.g. if you join a course that is not fully booked).
4. Changes
Aerial Silk Vienna reserves the right to postpone or cancel events for important reasons (e.g. insufficient number of participants). In the event of cancellation, Aerial Silk Vienna will offer an alternative date or refund the course fee. The use of another instructor does not entitle the customer to a reduction in payment and/or cancellation.

5. Exclusion of liability
The customer is advised that there are no lockable lockers on the ASV premises. Any items brought into the changing room must be left unattended. Any valuables brought along must be taken into the course room. Unless the involvement of ASV employees can be proven, liability is excluded in the event of loss of clothing, valuables or money brought along.
The use of ASV services is at the participant's own risk. ASV is not liable for accidents or resulting physical injury to customers. ASV is also not liable for the consequences of improperly performed exercises. In this regard, reference is made to point 6.

6. State of health of the customer
By registering for a course or workshop, each customer bindingly declares that he/she is physically healthy, mentally stable, able to cope with the relevant physical and mental demands, and will only participate in such a condition. Participation under the influence of drugs, alcohol or medication is not permitted. By participating, the customer assures that he/she does not suffer from any infectious disease and that no medical reasons prevent him/her from performing the exercises. In case of doubt, a doctor must be consulted. Chronic illnesses and other physical or mental ailments that could affect or endanger other participants must be reported to the course instructors before the start of each class. In the event of pregnancy, a doctor's clearance must be obtained before participation.

7. Participation in open training sessions
Open training sessions are times when the ASV premises can be used for your own training. These are sessions without an ASV trainer. An open training host who has been instructed by ASV on the safety rules is the supervisor. Participation in open training sessions is only permitted if you have completed ASV safety training and are aged 18 or over.

8. Data protection regulations
The customer's data will be used for the purpose of fulfilling the contract, possibly for our own advertising purposes, and will not be passed on to third parties. The customer agrees to his/her data being stored in ASV's IT system for a maximum period of 10 years after the last visit to the studio. All data will be treated confidentially in accordance with the applicable data protection regulations.

9. Place of jurisdiction, applicable law
The exclusive place of jurisdiction shall be the competent court for 1010 Vienna, Austria.
10. Miscellaneous
There are no collateral agreements to these GTC. Amendments to these GTC must be made in writing, as must the submission of amendments. Should individual clauses of these GTC be invalid in whole or in part, this shall not affect the validity of the remaining clauses and the contract shall remain valid in principle, whereby the invalid clause shall be replaced by a clause that comes as close as possible to the economic purpose of the invalid clause. The written form requirement shall be met by transmission by email. If the customer has provided an e-mail address, all messages between the contracting parties may be sent by e-mail.
